As it turns out, 37-year-old was arrested in 2015 for allegedly raping and sodomizing a 12-year-old girl on multiple occasions, and now he has filed a motion to ask the judge to give them access to the minor’s sexual history.
“Our firm has a good faith basis to believe that the complainant in this case has had intimate physical contact with a man who is not the defendant in this case and who is older than 17 years of age and who may have caused there to be physical evidence of repeated vaginal and anal penetration of the complainant,” Maraj’s lawyers, Benjamin Brafman and Andrea Zellan wrote, according to documents obtained by Bossip.
During a hearing in July, the court found a match between Maraj’s DNA and semen found on the victim’s pants. The court then offered Maraj a plea deal of 15 years in prison. He declined.
Nicki reportedly posted $100,000 in bail, putting up two of her properties, for her brother. The alleged tween victim told police that Maraj repeatedly raped and sodomized her between April 1 and November 30, 2015. Maraj plead not guilty to the charges against him when he was indicted in April 2016.
“We believe the truth will come out,” David Schwartz, Maraj’s lawyer, told Bossip yesterday (March 2). “The complaining witness in the case and others have a real motive in this case to lie, this never occurred and Jelani is completely innocent.”
The case goes to trial later this month.
